As a pop star protest against “indentured servitude” by penny pinching record companies grew to near-deafening decibel levels on Tuesday ahead of Wednesday’s Grammy Awards, the music industry roared back. Led by Don Henley and Sheryl Crow, the Recording Artists Coalition has been demanding changes to a California law that ties musicians longer to contracts than in other industries. Music publishers and songwriters said Tuesday they had joined the growing list of media companies suing file-sharing company Aimster for copyright infringement, saying that the service is trying to fill the void left by Napster. In a complaint filed this morning in Los Angeles Superior Court, David Cassidy is seeking material damages in excess of $1 million, the amount to be determined at trial, as well as exemplary and punitive damages, against Bell Records, Arista Records and Bertelsmann Music Group. Cassidy claims that Arista/BMG, subsequent to merging and acquiring Bell Records, materially breached Cassidy’s recording agreement. In addition, Cassidy is claiming that Arista/BMG has breached their fiduciary duty to him as a recording artist and have improperly misappropriated his name and likeness in exploiting the albums.
