NEW YORK – The Dave Matthews Band kicked off its 2009 summer tour Tuesday night with a sold-out show at Madison Square Garden. From opening track “Don’t Drink the Water” to final encore “Tripping Billies,” the crowd exuded an energy and noise level that even Rangers and Knicks fans would have envied. LOS ANGELES (Billboard) – Three years after the former manager of The Killers sued the band for alleged breach of contract, the group has filed a countersuit claiming a pattern of incompetence and double-dealing. The Killers' lawsuit, filed Friday in federal court in Las Vegas alleges breach of contract, breach of fiduciary duty and unjust enrichment as well as breach of an implied good-faith covenant by former manager Braden Merrick and his company, From the Future. The day after Dave Matthews releases his RCA solo debut, “Some Devil,” the Dave Matthews Band will play a benefit show in New York’s Central Park that is expected to draw upwards of 100,000 people. Full details of the Sept. 24 event will be announced Friday (Sept. 12). America Online is sponsoring the show and is using it to hype the newest version of its software, AOL 9.0. Guns N’ Roses’ surprise performance at Thursday’s 19th annual MTV Video Music Awards was easily the night’s highlight presentation, even though P. Someone should give Gen. Colin Powell another bronze star. Last week the secretary of state went on MTV and committed an unabashed act of heroism. He threw himself into the debate over condom use as a way to fight AIDS – and rounds of flak have been flying at his head ever since. No, the jam band hasn’t lined up a string of promotional gigs in supermarket parking lots. The group is the inspiration for a new flavor of Ben and Jerry’s ice cream, according to the band’s publicist.
