A Chicago judge has dismissed a class-action lawsuit against the band Creed, filed by four fans who attended the Orlando-based band’s concert in Chicago on December 29, 2002, according to the Orlando Sentinel. Jeff Hanson Management & Promotions, Inc., and concert promoter USA Interactive were also named as defendants. Three months after four fans sued Creed alleging that Scott Stapp was so wasted he couldn’t perform at a December show in Chicago, the band’s singer has responded and denied the allegations. In fact, Stapp told the Orlando Sentinel on Monday that, quite to the contrary, he was offering an over-the-top, dramatic gesture meant to convey the difficulties he was facing in his personal life at the time. Scott Stapp and humor hardly go hand in hand, but Joey Fatone is doing his best to change that. The ‘NSYNC singer is parodying Creed’s “Higher” on his upcoming comedy album. “I want to do ‘Can You Change My Tire?’ ” Fatone said Monday. “Just silly stuff, something stupid like that.” Creed are Fatone’s first victims outside of his own ‘NSYNC circle. Can you take Scott Stapp “Higher”? No, say some disgruntled Creed fans, so they’re taking him to court. On Monday, a quartet of Creed faithful filed suit against the rock group, demanding their money back from a concert at the Allstate Arena in Rosemont, outside Chicago on December 29. Dashboard Confessional and Jack Johnson played acoustic, and Beck and Coldplay celebrated Christmas, but otherwise KROQ-FM’s annual Almost Acoustic Christmas was a two-day, 20-act festival all about rocking. Word has surfaced that the ex-wife of Creed’s Scott Stapp was arrested earlier this month for aggravated battery with a weapon after she hit the famed rocker in the face with a cell phone during an argument in the bedroom of his Orlando, Florida home. Hillaree Stapp “picked up a cell phone and punched [Scott] with it across his left side of his face” with enough force to cause his head to “jerk to the right,” according to a report filed by the Orange Country (Florida) Sheriff’s Office.
