Court Blocks FCC Media Ownership Rules

A federal court Wednesday blocked controversial new Federal Communications Commission media ownership rules pending a full judicial review in a major blow to large media companies. In a loss for the Republican-led FCC, the three-judge panel of the Third U.S. Circuit Court of Appeals in Philadelphia granted a stay order that prevented the new rules from taking effect as scheduled on Thursday. Critics argued that the FCC rules would concentrate too much power in the hands of media moguls. The new rules were backed by media giants including Viacom Inc.’s CBS, General Electric Co.’s NBC and News Corp. Ltd’s Fox… Read more »

Lawyers Probe Music File-Sharing Hunts

Lawyers for a New York woman accused of unlawfully sharing music over the Internet suggested Tuesday the recording industry acted illegally when it investigated her online activities and that a search of music files on her computer may have been unconstitutional. The lawyers – Richard S. Ugelow, Glenn W. Peterson and Daniel N. Ballard – are asking a federal magistrate to delay at least until Sept. 10 ordering the woman’s Internet provider to turn over her name and address to the Recording Industry Association of America, the trade group for the largest labels. In court papers, the lawyers said they… Read more »

'N Sync Pays Overdue Tax Bill to Ohio

City tax officials say they’ve collected an overdue tax bill from ‘N Sync and the band’s management after several reminders and two lawsuits. The account was “paid in full” as of Thursday, city tax administrator Melinda Frank said Friday. She could not confirm the amount because the payment had not been entered into the city’s computer system by the close of business. Two lawsuits, each covering a separate aspect of the city income tax law, sought a total of $7,861 for back taxes, interest and penalties for income earned in the city in 2000 and 2001. The group paid slightly… Read more »

FCC Radio Rules Under New Scrutiny

Any effort to rewrite the latest federal rules for radio must include a broad investigation into such issues as “pay-for-play” and artist intimidation, according to music and artists’ groups. Michael Bracey, director of government relations for the Future of Music Coalition, says his group wants the Federal Communications Commission to examine “pay-for-play and vertical integration” in the radio industry. The group opposes FCC rule changes that were enacted June 7. And Jay Rosenthal, co-counsel of the Recording Artists’ Coalition (RAC), wants the commission to follow up on reports of artist intimidation. “The FCC can no longer ignore evidence of radio… Read more »

Give it up for Eminem!” “You’ll be hearing those songs at strip clubs for years to come” – after Christina Aguilera performed “Dirrty.” “Our next presenter is being sued by more people that the Catholic church. California Court Rules for DVD Industry

The California Supreme Court ruled Monday that courts may block Internet users from posting codes that could be used to illegally copy DVD movies, in a case that pitted trade secret rights against free speech. The justices did not resolve whether the code was in fact a trade secret, leaving that for a lower court to determine. They did rule, however, that they would not tolerate the posting of legitimate trade secrets online and reversed a lower court that said disseminating trade secrets was protected free speech. The case centered on San Francisco computer programmer Andrew Bunner, who in 1999… Read more »

Rhode Island Club Owners, Band Fined $100K

Six months after a deadly nightclub fire, the club’s owners and a rock band were fined nearly $100,000 by the federal agency that regulates workplace safety. Legal experts say the move could bolster lawsuits filed after the Feb. 20 blaze, which killed 100 people and injured nearly 200 others at a Great White concert. “It’s not absolute proof of negligence, but it will be used as evidence to illustrate negligence,” said David Yas, editor of Rhode Island Lawyers Weekly. He said that the Occupational Safety and Health Administration’s decision Wednesday “certainly carries some power.” The agency fined Derco LLC, which… Read more »
