Sony Music must pay the founder of a small record company $5 million for failing to put his company’s logo on reissues of Meat Loaf’s “Bat Out of Hell” album, a federal appeals court ruled. Steve Popovich, 65, who started Cleveland International Records in 1977 and soon afterward signed the chubby singer named Marvin Lee Aday, persuaded Epic Records to release the wildly successful album. Epic was owned at the time by CBS. Sony, which bought out CBS Records, paid $6.7 million to Popovich and his former partners in 1998 to settle a lawsuit over royalties from the album. Jasun Martz, a producer and musician who has recorded for Michael Jackson, toured with Frank Zappa and helped arrange Starship’s classic hit We Built this City, recently found an old, dusty suitcase in the corner of his attic. Inside was a small canvas painting and unmarked audio tape. An unreleased Michael Jackson or Zappa outtake, he thought? The Eagles will perform during this fall’s Country Music Association Awards for the first time, a nod to the success of their new single, “How Long,” on country radio. The song is from the group’s first new studio album in 28 years, “Long Road out of Eden,” which will be released next month. Two people injured when pyrotechnics went awry at Beyonce Knowles’ concert in St. Louis received a surprise emergency room visit from the singer. The accident happened Sunday night, just as the R&B star’s concert began. A spokeswoman for Scottrade Center didn’t return phone calls seeking comment, but broadcast reports said pyrotechnics meant for the stage accidentally spilled into the front row. Bon Jovi topped the U.S. album charts for the first time since 1988 on Wednesday, while rock duo the White Stripes scored a personal best with a No. 2 debut for their latest release. Bon Jovi’s “Lost Highway” sold 292,000 copies in the week ended June 24, the rock troupe’s biggest one-week sum since Nielsen SoundScan began tracking sales data in 1991. The Smashing Pumpkins announced Monday they will give nine concerts in Asheville and eight in San Francisco this summer in the band’s first residencies in more than a decade. The band will perform at the Orange Peel in Asheville on dates from June 23 to July 5, and at the historic Fillmore in San Francisco on dates from July 22 to August 1.
