Jardine Loses "Beach Boys"

Founding Beach Boy Alan Jardine received a severe legal setback Monday, when a U.S. District Court ruling prohibited him from touring with his band under the name the “Beach Boys Family and Friends,” as he did throughout 1999.

Instead, he may continue as the “Family and Friends Beach Band.” “The Beach Boys” moniker is used by the touring band featuring another founding member, Mike Love.

“We are happy with the result,” said attorney Mike Flynn, who represents Brother Records International (BRI) the Beach Boys’ corporate entity. “This terminates his entire case.”

Jardine’s attorney Jeffrey Benice said the ruling will be appealed. Furthermore, this ruling will not affect the $4 million lawsuit Jardine filed June 30th against Love and Brian Wilson, which alleges that he has been excluded from recent Beach Boys concerts.

Benice, hired by Jardine in June, takes over from Vincent Chieffo who handled Jardine’s legal affairs for several years. Benice said this move will allow Chieffo to testify during the upcoming appeal.

Flynn said that Jardine receives revenue from the Love-led Beach Boys tour, per the initial corporate agreement. He added that BRI had offered to settle financially with Jardine several times, but will not grant him use of the Beach Boys name.

Jardine could not be reached for comment.
